Apple appeals US ban on Watch Series 9 and Ultra 2

Apple has appealed the decision that bans the sale of its Watch Series 9 and Watch Ultra 2 models in the US.

Impact of US ban on Apple

In its latest filing, Apple said it "will suffer irreparable harm" if it is banned from selling its two most popular watch models, a report by The Verge citing the company's filing.

To recall, Masimo accused the tech giant of hiring away its employees, stealing its pulse oximetry technology, and incorporating it into the Apple Watch, Reuters reported.

The US International Trade Commission's (ITC) order bars imports and sales of Apple Watches that have blood-oxygen reading technology. The pulse oximeter feature has been in Apple watches since the Series 6 model was released in 2020.

Apple asked the Federal Circuit to pause the ban at least until US Customs and Border Protection issues its decision on redesigned versions of the watches. The decision is expected on January 12, 2024.

The ITC has already rejected Apple's request to pause the ban during the appeal process. It also opposed the company’s request for the Federal Circuit to halt the ban in a court filing on Tuesday.

A Masimo spokesperson called the decision "a win for the integrity of the US patent system, and ultimately American consumers."

Sales of Series 9 and Ultra 2 have been on a halt since last week. Other models, meanwhile, are not affected like the Watch SE.
