NTC proposes regulation to stop unauthorized sale of stolen smartphones, gadgets

The National Telecommunications Commission (NTC) is reportedly set to issue rules covering the sale of used and refurbished mobile phones, tablets, and other gadgets.

NTC wants to tighten rules on used and refurbished gadget trade

Why? It aims to curb the unauthorized trade of stolen, tampered, or defective devices. The proposed circular sets out rules on importation, dealership accreditation, labeling, and sales.

A public hearing was held on September 23 with telcos, prospective applicants, and stakeholders in attendance. Written submissions have also been received, including concerns over intellectual property rights.

Public telcos, potential applicants, and industry stakeholders took part in the hearing.

Based on the draft, only legitimately sourced and type-approved devices with proper documentation may be imported. Units must be labeled, graded, and warranted by accredited dealers before being sold.

The public hearing presented the proposal to allow the importation and sale of NTC-type approved and untampered refurbished mobile phones, tablets and similar devices which shall be boxed and identified under the brand of the authorized person or entity granted by the NTC and sold with a one year repair or replacement warranty,” the telecommunications industry regulator said.

Entities found importing or trading without authorization will face administrative sanctions. The NTC is accepting public comments and recommendations until October 1, 2026, via email at commissioner@ntc.gov.ph, with copies to its legal office.
